Convert pistol to SBR
Just a quick ?? Let's say I started out with an AK pistol and armed with the proper paperwork filled out and applied to ATF to build a SBR, and with an underfolder stock, misc parts and tools and the knowhow and converted it to a SBR ala Krinkov...........Legal NO-NO since it started out as a pistol? Got something milling around in my head and would not want to do anything illegal.

Actually, since you are startng from a pistol you could build either a AOW or SBR from it. If you are doing it on a from 1 might as well just paper it for SBR. It is $200 either way. If your SOT is doing it on a from 2, the AOW would only be a $5 transfer fee (but of course no stock would be allowed).
Dont buy that stock away till you get the approved paperwork back.. wouldnt want to get busted for constructive possession. |

Note: if you go the Form 1 route, then you are creating a "rifle" so I beleive the Compliance Parts count needs to be considered, which may not be the case with your pistol's current configuration. See info below.
Section 922(r), of Title 18, U.S.C. prohibits assembly of certain semiautomatic rifles from imported parts. The implementing regulations in Title 27, Code of Federal Regulations (CFR) section 178.39(a), provide that no person shall assemble a semiautomatic rifle or any shotgun using more than 10 of the imported parts listed in paragraph (c) of this section if the assembled firearm is prohibited from importation under section 925(d) (3) as not being particularly suitable for or readily adaptable to sporting purposes.For further information about 922(r), go to the ATF website http://www.atf.gov/ or http://uscode.house.gov/ and search for 18 U.S.C. § 922(r) and 27 CFR § 478.39 of the Gun Control Act (GCA) of 1968. NO, creating a SBR is not creating a rifle, it is creating a SBR which is an NFA item. NFA items are NOT "a semiautomatic rifle or any shotgun" so 922r does not apply since it is NOT a rifle in this case.
