The atf has not approved any uppers in the past year. Possibly 1.5-2 years

Maybe there will never be any new uppers

I just e-mailed Craig at Tactical Innovations asking him if there is any updates. I will let you know if I hear anything back. I e-mailed him back in May, but received no reply.

With these uppers not being approved for sale, could we all just make them ourselves? What are the legalities of selling plans for a gun, and is it legal to make our own, as long as it is not sold?

It's perfectly legal to sell any non-firearm without an ATF determination. The issue you run into is that if the ATF then later makes a determination that the product is actually a firearm or even worse is a machinegun the company runs the risk of being fined for and perhaps even charged with willfully manufacturing and selling a machinegun. That plus all of your stock is now seized and any you've sold must be turned over to the ATF by your customers means a lot of lost capital and revenue. At some point, if the ATF is going to refuse to make pre-determinations, companies are going to have to take their chances. Whether that results in suing the ATF to require a determination (or having a court rule on the status of the product) or paying qualified industry experts to evaluate the product (not sure who would take on that liability) or just selling it in good faith as a non-firearm/non-machine gun (which I assume would spur the ATF into making a determination rather quickly...), something needs to be done.

That's for sure. What about setting up a front company to make and retail the parts with ownership of the tooling and intellectual property owned by the original company in case of a BATFE negative decision? I worked at a small factory that on paper was about ten different companies - one owned the raw material which sat on the shelves of another company in the building of another company, etc. it was done in case they were sued for a faulty product to keep all of the assets from going away to the plaintiff and lawyers. I'm sure that a lot of importers of potentially dangerous Chinese crap like mopeds and chain saws do something similar. In the land of the lawyer do as the lawyers do.

Here is what I got from Craig;

We work on it when we can around everything else, which unfortunately is not a lot of consistent time. Like the M16 version, its a pet project that a couple of us here have a personal interest in and we do what we can on it when we can. I'm reluctant to provide specific updates and information, not because there is any bad news or problems as everyone always infers, but because experience has taught me that "updates" then generate substantial phone calls and emails from interested shooters who then want more information, which consumes a lot of time that is not productive.

We still plan to offer an M11 version but won't take deposits or promise shipping times until they are boxed and ready for UPS to pickup. Sorry, I wish I had a better answer for you but that's where we are.

I called them today and asked about it, she didn't even seem to remember it but she said it might be on the back burner. Her actual words were that there are having such a hard time making parts for their AM-15 uppers that no one's really thinking about it right now.

Doesn't sound like they ever submitted it.

Just for the heck of it though and just in case I went ahead and bought three drums to be future-proofed.
