NY Galil ownership - legal?

Is it leagl to own a Galil based on the NY Assualt weapons ban:

22. "Assault weapon" means (a) a semiautomatic rifle that has an
ability to accept a detachable magazine and has at least two of the
following characteristics:
(i) a folding or telescoping stock;
(ii) a pistol grip that protrudes conspicuously beneath the action of
the weapon;
(iii) a bayonet mount;
(iv) a flash suppressor or threaded barrel designed to accommodate a
flash suppressor;
(v) a grenade launcher; or
(b) a semiautomatic shotgun that has at least two of the following
characteristics:
(i) a folding or telescoping stock;
(ii) a pistol grip that protrudes conspicuously beneath the action of
the weapon;
(iii) a fixed magazine capacity in excess of five rounds;
(iv) an ability to accept a detachable magazine; or
(c) a semiautomatic pistol that has an ability to accept a detachable
magazine and has at least two of the following characteristics:
(i) an ammunition magazine that attaches to the pistol outside of the
pistol grip;

Based on what you posted, I would say it would not be legal.

Galils have 1 and 2, so you have already reached the "at least two" part.
Many Galils also have 3 and 4.

The only solution I can think of off the top of my head is the Galil HADAR II, which has a solid wood thumbhole stock and a plain barrel.

But as I am not a person with any legal training, your best bet would be to contact your local legal-type people.

If you create a rifle that does not say "Galil" and has a muzzle break welded on, a wood/welded stock, and 10 round magazines, then yes it would be legal. But that is just butchering a work of art.

If it is a pre ban yes you can have one, If it's a post ban no evil parts and 10 round mag limit. I live in Westchester N.Y.
( N.Y. THE BIG ROTTEN APPLE ) Make sure you get a pre ban & you will be good to go.

If you create a rifle that does not say "Galil" and has a muzzle break welded on, a wood/welded stock, and 10 round magazines, then yes it would be legal. But that is just butchering a work of art.

There were some Galils that were "in transit" when the US AWB became law. They were modified in order to make them compliant with the federal ban, and they have an unusual serial number (an extra "S" stamped on them if I remember right). Anyway, the NY AWB provides exceptions based on the date of manufacture. I'm going from memory here, but if the serial number starts AA209xxx then it was made in 1989. In NY, the gun and the magazine are considered separately.

Magazines: According to the laws of the State of New York, a magazine with a capacity of more than 10 rounds manufactured after September 13, 1994 cannot be legally possessed by anyone other than a law enforcement officer.

Rifles: from NY Penal Code 265.00, the following is one of the exceptions to the NY AWB (basically a grandfather clause)...
(v) a semiautomatic rifle, a semiautomatic shotgun or a semiautomatic pistol or any of the weapons defined in paragraph (d) of this subdivision lawfully possessed prior to September fourteenth, nineteen hundred ninety-four.

My Galil made in 1989 is good to go. So are the 25-round mags, which are stamped with a date code in the late 1980's.

Based on the fact that the Constitution is the supreme law of the land in all 50 states, yes it is technically legal. But if you get caught with one in NY the police will arrest you and they will lock you up in prison for at least 10 years and probably fine you for at least $250k.

I had read somewhere, a while back, that they can own a Magnum Research model which is legal since it doesn't have Galil stamped on the receiver. Is this correct?

Pre-ban is ok in NY, and they're all ok - MR, AA, and springfield, since they were made pre-1994.
