Hey guys I’m planning on selling a M10 in state. I’ve bought but never sold a machine gun it kind of goes against my SOP. My question is what steps do I need to go through. Do I need to get a form from the ATF ? If it sells do I need to hold the money till they get their tax stamp ? Thanks

They need to send off everything. You start by putting the info that pertains to you and handing it off to them.
I'd get 100% funds up front and then give them all the parts except the registered lower.
Some people do a 50/50 sale. Whatever you want is what happens, you're the seller, your rules.

When the stamp comes back it would be mailed to you. Call him when you get it.

I'd advise (as described above) that YOU fill out (and sign) only the portion of the forms that pertain to you.
Make sure to check the box allowing the buyer to contact the ATF concerning the gun.

Make the buyer actually mail in the form etc. That way he cant hound YOU about it taking forever. Instead he can beotch at the ATF.

I'd get 100% funds upfront. Screw 50/50 unless you are a gun dealer etc.

i would do the form 4 together....both look it over....when i bought my mac 11a1 this past year the guy had it all filled out and it was 2 generations old paper work...i saw errors and things that can cause a kick back here in WI...i redid it all and handed it to him to sign...i (the buyer) handed it all in....if there is an error its my fault....i paid him 100% up front and i took everything except the registered part...

i would never consider 50/50....your not a dealer......and its a mac...if they dont have $6-8k they dont belong buying a machine gun....its not a $35k gun....

good luck---since your market is local i would not expect full dealer pricing....unless you live in a State where FA is popular...the gun i bought sat for 6 months for sale and i got quite a bit off the asking price as he was asking a national/dealer price...which got his ad on Sturm ignored for the most part.

Use silencershops form 4 generator to make the form 4 with the person buying it.

https://eform4.silencershop.com/

It makes filling out the form 4 easier and the pdf it generates prints right(I've had problems with the atf's form 4 skipping the blank pages when it prints). Sign and print your name on them and give them to the person to put passport photos on and mail off to the atf. When the atf approves the form 4 they will mail them to you. Make a photocopy for your records and then hand the original and the machinegun to the new owner.

Bonus option: You can sell the stamp off your original form 4 to a normal stamp collector. Most of them haven't seen the atf stamps and want them. They are not worth a lot(I think like 20 to 30 bucks) but its extra cash and you will make someone happy.
