Legality question

There have been some full size pistols, like the PPS-43, that have had the folding stock welded in place and made inoperable. My question is could a welded Uzi folding stock be added to a full size Uzi pistol, or a pinned MP5A3 stock added to a SP5/AP5/Z5P and still be considered a pistol. Purely for looks, not functionality as a stock.

As far as the purpose is solely for look, it shouldn't be a problem.

While I agree with others who have said this is logically consistent with previous ATF decisions, please remember that the ATF is not always logically consistent in their decision making. The opinions expressed here would not have a bearing on the ATF's decision to prosecute you. If you are making decisions in this regard, the safest thing is to ask the ATF directly and make sure to get a response in writing.

Unfortunately ATF letters are not worth much anymore. How many arm brace and "80%" makers had one? Might help sway a jury, but ATF can and does change their mind.

I have seen a copy of an ATF approval letter for a welded closed UZI folding stock published "somewhere" on a web forum.Hopefully it is something that can be found with a GOOGLE search.

As long as it's pinned in a manner that makes it obvious you can't undo things on the fly within seconds its the same thing as a fixed stock. Even if you could remove the pin in a second I'd think its still legally a fixed stock you just run the risk of muddying the waters with something not overly permanent.

I agree with the Gun Lives Matter on this one. I would either SBR it or buy a Carbine length barrel and put the Stock on her. You can change barrels on an Uzi very easily, but not a HK. Just my $.02

$200 tax stamp or a welded up $30-40 stock? I would weld the stock if you have no desire to get into the NFA realm and the new rules it brings. Drill a hole into the stock with it folded and put a pin in it so it won’t open. Then weld that pin, just like a pin and weld for a muzzle device. That is my suggestion.

ATF letters don’t mean a thing anymore and if you call them 10 times for advice you’ll get 10 answers that don’t hold weight of law.

As long as it's permanently welded in the folded position and can no longer function as a stock, it's only a "cosmetic feature".
I've done several MACs that way and all have passed scrutiny.
I'd be more concerned about satisfying a local LEO's curosity/interest. You're more likely to run across a deputy sheriff or P.D. officer
than an ATF agent in your daily travels.

I bought a welded shut folding stock from BWE when they were around for just that purpose.
If the OP started with a pistol build that is kosher, from reading... like with AR's you can't just decide to convert to a pistol if you started with a rifle.
Not all states require pistol marked receivers from what I hear (?) unsure of those details anymore.
Another thread here someone said that if you have a pistol made into a rifle, then the quick detach stock is AOK, vs if you were fitting it to a rifle.
That makes sense (because you are converting to a pistol when you detatch) but....
